Mental health care access and regulation tracker (2026)
As of 11 October 2026, the new parts of the 2024 parity rule are not being enforced, and the Labor Department is preparing a new rule.[1][2] About 154.6 million people live in mental health shortage areas. The Counseling Compact is live in ten states. Medicare telehealth flexibilities run through 2027.[3][4][5]
What we know
- The Departments are not enforcing the parts of the 2024 parity rule that are new relative to the 2013 rule[1]
- MHPAEA's statutory obligations still apply[7]
- EBSA's September 2026 bulletin prioritises mental-health-only exclusions, medical necessity and prior authorisation, and network adequacy[8]
- 7,127 mental health shortage designations cover about 154.6 million people, as of 30 September 2026[3]
- The Counseling Compact is live in ten states; 29 more states and DC are preparing[18]
- Medicare's in-person rule for mental health telehealth at home applies after 31 December 2027[12]
- No generative-AI mental health device had been authorised by FDA as of November 2025[15]
What we don't know yet
- When the Departments will propose a replacement parity rule, and what it will keep from the 2024 rule
- How the ERIC lawsuit over the 2024 parity rule will be resolved
- When the remaining Counseling Compact member states will begin issuing privileges
- Whether Congress will change Medicare's in-person requirement for mental health telehealth before 2028
- Whether FDA will issue guidance on generative-AI mental health devices, and what the FTC's chatbot inquiry will produce
- How BetterHelp's shift to insurance and UHS's ownership of Talkspace will affect prices and availability
Story status
This tracker follows changes that affect whether people in the US can find, afford and safely use mental health care: parity rules, workforce shortages, licensing across state lines, telehealth coverage, online therapy companies and AI chatbot rules. It is updated as of 11 October 2026. Rules vary by state and plan, so check with your plan or the relevant agency. This page is not medical or legal advice.
If you are in crisis: call or text 988 in the US. In the UK and Ireland, call Samaritans on 116 123. Elsewhere, see findahelpline.com.[6]
Parity
The new parts of the 2024 parity rule have not been enforced since May 2025, while the Departments reconsider it.[1] The statute still applies.[7] In September 2026 the Labor Department set enforcement priorities in a new bulletin. A law firm analysis says a new final rule is expected by the end of 2026, which is a forecast, not a date set by the government.[8][2] Background: mental-health-parity-law.
Workforce and licensing
HRSA’s 30 September 2026 data show 7,127 mental health shortage designations covering about 154.6 million people, with 26.24% of need met.[3] Most designations are based on psychiatrist numbers alone.[9] The Counseling Compact went live in eight more states during 2026, reaching ten on 1 October, and the Commission reported 3,000 privileges issued.[10][4][11]
Telehealth and online therapy
CMS says Medicare telehealth flexibilities run through 31 December 2027. The in-person rule for mental health telehealth at home starts after that date.[5][12] Among online services, Teladoc is moving BetterHelp to insurance, and UHS bought Talkspace in August 2026.[13][14] See the services guide.
AI chatbots
No generative-AI mental health device had FDA authorisation as of November 2025. Illinois bans AI-delivered therapy, while Utah regulates mental health chatbots through disclosure rules.[15][16][17] See the AI chatbots analysis. For crisis services, see the 988 and crisis care tracker.
